By accessing the Site, using our Services or placing an order, you agree to these Terms, together with our Privacy Policy, Return & Refund Policy, Shipping Policy and any other policies referenced on the Site.

Nothing in these Terms limits or excludes any mandatory rights you may have under applicable consumer protection law.

2. Use of the Site

You may use the Site only for lawful purposes and in accordance with these Terms.

By using the Site or placing an order, you confirm that you have the legal capacity to enter into a binding contract under the laws applicable to you.

If you are under the legal age required to enter into a contract, you may only use the Site with the involvement and consent of a parent or legal guardian.

You may not use our products or Services for unlawful purposes or use the Site in a way that could damage, disable, overload or impair its operation.

3. Products

We make reasonable efforts to display and describe our products as accurately as possible.

However, colours, textures, finishes and other visual details may appear slightly different depending on your device, screen settings, photography, lighting or the natural characteristics of the product.

Certain ISLA products and tools may be handmade or produced using natural materials. Small variations in appearance, shape, texture or finish may therefore occur and do not necessarily constitute a defect.

Product packaging may occasionally be updated or vary slightly from the images displayed on the Site, provided that this does not materially affect the product purchased or your statutory rights.

All products are subject to availability.

4. Matcha and Food Products

Our matcha is a food product and should be stored, prepared and consumed according to the information and instructions provided with the product.

Any information provided on the Site about matcha, ingredients, preparation, rituals or lifestyle is provided for general informational purposes and is not intended as medical or healthcare advice.

If you have allergies, sensitivities, dietary restrictions, are pregnant, are taking medication or have a health condition that may affect whether a product is appropriate for you, you should seek appropriate professional advice where necessary.

Always check the product packaging and ingredient information before consumption.

Nothing in this section limits our responsibility to supply products that comply with applicable food safety and consumer protection laws.

5. Prices and Taxes

Prices displayed on the Site are shown in the currency applicable to the market you are shopping from.

Where required, prices include applicable VAT or other sales taxes.

Shipping charges and any other applicable costs will be displayed during checkout before you place your order.

For orders delivered outside the European Union, the recipient may be responsible for local customs duties, import taxes, fees or other charges imposed by the destination country, unless expressly stated otherwise at checkout.

We are not responsible for charges imposed by customs or local authorities that were not collected by us at checkout.

6. Orders

By placing an order through the Site, you are making an offer to purchase the products included in your order.

After placing your order, you will receive an electronic confirmation acknowledging receipt of your order.

All orders are subject to availability, successful payment authorisation and acceptance by ISLA.

We reserve the right to refuse or cancel an order where there is a legitimate reason to do so, including suspected fraud, payment issues, obvious pricing or product errors, stock unavailability, shipping restrictions or misuse of promotional offers.

If we are unable to accept an order after payment has been made, we will inform you and refund any amount paid for the affected products without undue delay.

7. Order Information

You are responsible for ensuring that the information provided when placing an order is accurate and complete, including your name, email address, billing information and delivery address.

Please review your order carefully before submitting it.

If you notice an error after placing your order, contact us as soon as possible at hola@islaisla.com.

We will make reasonable efforts to amend the order where possible, but changes cannot be guaranteed once an order has entered fulfilment or has been dispatched.

8. Payment

Payment must be made using one of the payment methods available at checkout.

Payments are processed through Shopify and/or authorised third-party payment providers.

You agree to provide current, complete and accurate payment information and confirm that you are authorised to use the payment method provided.

We do not generally receive or store your full payment card details directly.

Your payment provider may apply its own terms, conditions and security procedures.

9. Shipping and Delivery

We deliver to the destinations displayed as available during checkout.

Estimated delivery times are provided for guidance and may vary depending on the destination, carrier, customs procedures, weather, public holidays and other circumstances outside our reasonable control.

Applicable shipping charges and estimated transit times are displayed before checkout or described in our Shipping Policy.

We will make reasonable efforts to deliver orders within the estimated delivery period.

Your statutory rights in relation to delivery are not affected by these Terms.

Please refer to our Shipping Policy for further information.

10. Returns and Right of Withdrawal

If you are a consumer purchasing online in the European Union, you generally have the right to withdraw from your purchase within 14 calendar days of receiving the goods, subject to the exceptions provided by applicable law.

Certain products may be excluded from the right of withdrawal, including, where legally applicable, products that deteriorate or expire rapidly and sealed products that are not suitable for return for health or hygiene reasons once unsealed.

In particular, matcha or other food products that have been opened, unsealed or used may not be eligible for return where an applicable legal exception applies.

Full details about returns, refunds, return shipping costs and excluded products are provided in our Return & Refund Policy.

Where required by applicable law, customers may also exercise their right of withdrawal using the electronic withdrawal functionality made available through our Site.

Nothing in this section limits your statutory rights where a product is defective, damaged, incorrect or otherwise not in conformity with the contract.

11. Damaged, Defective or Non-Conforming Products

We are legally responsible for supplying goods that conform to the contract and comply with applicable consumer protection laws.

If you receive a product that is damaged, defective, incorrect or otherwise not in conformity with your order, please contact us at hola@islaisla.com.

Depending on the circumstances and applicable law, you may be entitled to repair, replacement, a price reduction, refund or another statutory remedy.

Nothing in these Terms excludes or restricts any legal guarantee or statutory conformity rights available to consumers.

12. Promotions and Discount Codes

From time to time, ISLA may offer discount codes, promotional offers, gifts, launch offers or other promotions.

Unless otherwise stated, promotional codes:

  • cannot be exchanged for cash;

  • cannot normally be combined with other promotional codes;

  • must be used within the stated validity period; and

  • may be subject to minimum spend, product, geographic or customer eligibility requirements.

The specific terms communicated with a promotion will apply to that promotion.

We reserve the right to cancel or refuse the use of a promotional code where there is fraud, misuse, technical error or a breach of the applicable promotional conditions.

This does not affect orders that have already been validly concluded except where permitted by applicable law.

13. Product Availability and Purchase Limits

We may limit the quantities of certain products available for purchase where reasonably necessary, including for limited releases, launches or stock management.

We may also apply reasonable purchase limits per customer, household, account, payment method or order.

Any such restrictions will be applied in a fair and non-discriminatory manner.

14. Accuracy of Information

We make reasonable efforts to ensure that information on the Site is accurate and up to date.

Occasionally, there may be typographical errors, inaccuracies or omissions relating to product descriptions, availability, pricing, promotions, shipping charges or other information.

If an obvious error affects an order you have placed, we will contact you as soon as reasonably possible and provide an appropriate solution in accordance with applicable law.

We will not intentionally alter the terms of an already concluded consumer contract without your agreement where such agreement is legally required.

15. Intellectual Property

All content made available through the Site, including the ISLA name, branding, logos, graphics, photographs, videos, designs, packaging designs, text, product names, illustrations, website layout and other original content, is owned by or licensed to ISLA and is protected by applicable intellectual property laws.

You may access and use the Site for your personal, non-commercial use.

You may not reproduce, copy, distribute, modify, publish, commercially exploit or create derivative works from our content without our prior written permission, except where permitted by law.

Nothing in these Terms grants you ownership of any ISLA intellectual property.

16. User Content

If you voluntarily submit reviews, photographs, comments, feedback or other content to ISLA, you remain responsible for the content you submit.

Where you expressly provide content for publication or use by ISLA, you grant us a non-exclusive licence to use, reproduce and display that content for the purposes communicated to you and as otherwise permitted by applicable law.

You must not submit content that infringes third-party rights, is unlawful, abusive, misleading, defamatory or otherwise inappropriate.

We may remove user content from our own platforms where we reasonably believe it violates these Terms or applicable law.

17. Third-Party Services and Links

The Site may contain links to or integrations with third-party websites, services, payment providers, social media platforms or other external services.

These third parties operate independently from ISLA and may have their own terms and privacy policies.

We are not responsible for the content or practices of third-party websites that are outside our control.

This does not affect any responsibility that cannot legally be excluded.

18. Shopify

Our online store is powered by Shopify.

Shopify provides the ecommerce infrastructure through which we offer our products and Services.

Your use of certain technical features of the Site may therefore involve Shopify or other service providers.

Information about how personal information is processed through the Site is provided in our Privacy Policy.

19. Prohibited Uses

You must not use the Site or Services to engage in unlawful or fraudulent activity, infringe intellectual property or other legal rights, transmit malicious software, interfere with the security or operation of the Site, attempt unauthorised access to systems or accounts, harvest personal information unlawfully, impersonate another person, or use automated means to misuse the Site.

We may restrict or terminate access to the Site where reasonably necessary to protect our customers, business, systems or legal rights.

20. Disclaimer

We aim to keep the Site available and functioning correctly, but we cannot guarantee that access will always be uninterrupted or completely error-free.

We may temporarily suspend or modify parts of the Site for maintenance, security, technical reasons or improvements.

Nothing in these Terms excludes any warranty, obligation or consumer right that cannot legally be excluded.

21. Limitation of Liability

To the fullest extent permitted by applicable law, ISLA will not be responsible for losses that are not reasonably foreseeable consequences of our breach or for losses arising from circumstances outside our reasonable control.

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability arising from fraud, wilful misconduct, death or personal injury caused by negligence where applicable, or mandatory consumer protection rights.

If you are acting as a consumer, these Terms do not limit your rights under applicable consumer law.

22. Privacy

Your personal information is processed in accordance with our Privacy Policy.

Please review the Privacy Policy for information about what personal information we collect, how we use it, the legal bases for processing, cookies, data sharing and your privacy rights.

23. Suspension or Termination

We may suspend or terminate access to the Site where a user materially breaches these Terms, engages in fraud or unlawful activity, compromises the security of the Site or otherwise creates a serious risk to ISLA or other users.

Termination of access to the Site does not affect any rights or obligations that arose before termination.

24. Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be interpreted or limited to the minimum extent necessary, and the remaining provisions will continue to apply.

25. No Waiver

If we do not immediately enforce a provision of these Terms, this does not mean that we waive our right to enforce it later.

26. Governing Law and Consumer Rights

These Terms and any contract for purchases made through the Site are governed by Spanish law, without prejudice to any mandatory consumer protection rules that may apply in the country where you habitually reside.

If you are a consumer, nothing in these Terms deprives you of the protection granted by mandatory provisions of the law applicable to you.

Any dispute will be subject to the courts and authorities having jurisdiction under applicable law.

Nothing in these Terms requires a consumer to submit disputes exclusively to a court or jurisdiction where such a requirement would be contrary to mandatory consumer protection law.

27. Complaints and Dispute Resolution

If you have a complaint about an order, product or our Services, please contact us first at hola@islaisla.com so that we can try to resolve the matter.

Consumers may also have the right to contact the competent consumer protection authority or use an applicable alternative dispute resolution procedure where available.

Your right to bring a claim before the competent courts is not affected.

28. Changes to These Terms

We may update these Terms from time to time to reflect changes to our Services, business practices or applicable laws.

Any updated Terms will be published on this page together with a revised “Last updated” date.

Changes will not retroactively alter the terms applicable to an order already concluded unless permitted by law or expressly agreed with you where required.
